A newborn found dead — lungs float in the hydrostatic test; live birth established. The hydrostatic test (lungs + heart in water — aerated lungs float, proving breathing) distinguishes live birth from stillbirth — but fallacies exist (putrefaction gases float too; atelectasis sinks despite life). Corroborate — lung expansion, stomach air, cord/maceration signs. Live birth proved → infanticide/homicide investigation; stillbirth → different inquiry. The floating lung is the threshold — breath's evidence decides the charge.
